Terms of Service

Welcome to go!moku! These Terms of Service ("Terms") govern your use of the go!moku mobile application ("App", "Service", or "Game"). By downloading, installing, or using go!moku, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using go!moku, you confirm that you:

• Are at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial entertainment purposes

This license does not include the right to:

• Modify, reverse engineer, or decompile the App
• Copy, distribute, or sell any part of the App
• Use the App for any commercial purpose
• Remove or alter any proprietary notices

3. Virtual Currency and In-App Purchases

Virtual Currency

go!moku includes virtual currency ("Coins") that can be purchased with real money or earned through gameplay. You acknowledge that:

• Coins have no real-world monetary value
• Coins cannot be exchanged for real currency
• Coins are non-transferable between accounts or devices (unless using the same Apple ID)
• We may modify the value or availability of virtual items at any time

Purchases

All in-app purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. By making a purchase:

• You authorize the charge to your App Store payment method
• You understand that purchases are final (subject to Apple's refund policies)
• You are responsible for all purchases made through your account

4. Game Center and Multiplayer

go!moku uses Apple Game Center for multiplayer features. When using these features, you agree to:

• Comply with Apple's Game Center terms of service
• Treat other players with respect
• Not engage in cheating, harassment, or unsportsmanlike conduct
• Not exploit bugs or glitches for unfair advantage
• Not impersonate other players

We reserve the right to report violations to Apple and request account restrictions for players who violate these guidelines.

5. User Conduct

You agree not to:

• Use the App in any unlawful manner
• Attempt to gain unauthorized access to any systems or networks
• Interfere with or disrupt the App or servers
• Use automated systems (bots, scripts) to interact with the App
• Exploit any bugs, errors, or design flaws

6. Intellectual Property

All content in go!moku, including but not limited to:

• Graphics, artwork, and visual design
• Music and sound effects
• Game mechanics and rules
• Software code and architecture
• The "go!moku" name and branding

is owned by us or our licensors and is protected by intellectual property laws. Gomoku (Five in a Row) is a traditional game in the public domain; our implementation and presentation are proprietary.

7. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of leaderboards or statistics

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not responsible for any loss of virtual currency due to device issues, account problems, or service interruptions

9. Modifications to Service

We reserve the right to:

• Modify, update, or discontinue the App at any time
• Change game features, virtual item values, or pricing
• Reset leaderboards or statistics
• Update these Terms with reasonable notice

Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the App
• Constitutes fraud or abuse

You may terminate your use at any time by uninstalling the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
